Welcome to SecDash! These Terms of Use ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Service"). Please read these Terms carefully before using the Service.

1. Agreement to Terms

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service. This is a legally binding agreement between you and SecDash.

2. Description of Service

SecDash provides a platform that automatically scans applications, including those generated by AI tools like ChatGPT, for security vulnerabilities. We provide reports and actionable guidance to help you secure your applications. The Service is provided on a subscription basis, with different plans available ("Hobby", "Pro").

3. User Accounts

To access most features of the Service, you must create an account. You are responsible for safeguarding your account and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. You agree to provide accurate and complete information when you create an account.

4. Subscriptions and Payment

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring, periodic basis (a "billing cycle"). Billing cycles are typically set on a monthly or annual basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel it through your account management page or by contacting our support team.

We use a third-party payment processor (Stripe) to handle payments. Your payment information is subject to the privacy policy of the payment processor.

5. User Responsibilities and Prohibited Activities

You agree to use the Service only for lawful purposes. You are responsible for the legality of the code and applications you scan with our Service. You agree not to:

• Use the Service to scan applications or code for which you do not have proper authorization.
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorized access to the Service or its related systems.
• Use the service for any illegal or malicious activities.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of SecDash and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

The reports and data generated from your use of the service are your property. However, we may use anonymized and aggregated data to improve our services.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You may terminate your account at any time by canceling your subscription and ceasing to use the service.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for accuracy, we do not warrant that the results of our scans will be complete or error-free. You are solely responsible for the security of your applications.

9. Limitation of Liability

In no event shall SecDash, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which SecDash is based, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
